The Court of Appeal in Lagos has ruled in favour of the Mabudeje Royal Family, led by Prince Babatunde Adenusi, affirming their legitimate claim to the Agbowa-Ikosi throne in Ikorodu.
In a decisive judgment delivered on 30 May, the appellate court overturned the earlier ruling of the Lagos State High Court, which had recognised Prince (Barr.) Owolabi Saheed Momson (joined as the 8th Defendant) as the Abowa of Agbowa-Ikosi. The Appeal Court found that the trial court had mishandled the evidence and erred in its acceptance of Momson’s nomination.
Presiding over the case (CA/LAG/CV/1104/2023), Justice Ngozika Okaisabor held that the claimants—representing the Mabudeje Royal Family—were indeed members of the ruling house and thus entitled to nominate a candidate for the vacant throne. This directly contradicted the lower court’s dismissal of their claim.
